Difference between circle rate and market rate
What you need to know
- Circle rate is set by the state government and revised periodically (sometimes not for years) - it is a valuation FLOOR for tax purposes, not a market price forecast
- Market rate reflects actual negotiated transaction prices and moves continuously with demand, unlike the periodically-revised circle rate
- Stamp duty and registration charges are calculated on whichever is HIGHER - your actual price or the circle rate - so you cannot reduce duty by under-declaring below the circle rate
- When market rate is well below circle rate (can happen after a slowdown or where rates were revised sharply upward), buyers effectively pay tax on a value higher than what they are actually paying
- Different states use different names for essentially the same concept: circle rate (Delhi, UP, Haryana), ready reckoner rate (Maharashtra), guidance value (Karnataka), Jantri rate (Gujarat), guideline value (Tamil Nadu), market value (Telangana, Andhra Pradesh)

The law behind it
Indian Stamp Act s.47A - undervaluation and reference to Collector
If the sub-registrar suspects that the price stated in a sale deed is lower than the true market value, the document is referred to the Collector, who can independently determine the market value and demand the shortfall in stamp duty. This is the main legal check against under-declaring the sale price to save on stamp duty.

UP RERA General Rules, 2016 and Agreement for Sale/Lease Rules, 2018
Uttar Pradesh operates its RERA framework through two rule sets: the 2016 General Rules (registration, fees, procedure) and a dedicated 2018 rule set fixing the standard Agreement for Sale and lease terms used across UP projects, including in Noida and Greater Noida.
