The law behind it

Form 15CA and Form 15CB - remitting property sale proceeds abroad

Before an NRI can remit the sale proceeds of Indian property abroad, a Chartered Accountant must first certify the tax position on Form 15CB, and the remitter (or NRI) then files a self-declaration, Form 15CA, on the income-tax portal. The bank will not process the foreign remittance without both, along with proof of TDS already deducted/paid.

Form 15CA - Declaration for Remitting Money Abroad

Before a bank remits money abroad (e.g. an NRI's property sale proceeds), the remitter files this online declaration on the nature and tax status of the payment - typically alongside Form 15CB for taxable amounts above the threshold.

Form 15CA and Form 15CB for Remittances Abroad

Before a bank sends money abroad on behalf of an NRI or a resident, the remitter must usually file an online Form 15CA, backed by a Chartered Accountant's Form 15CB certifying the correct tax has been deducted. This is what lets banks process property sale proceeds or LRS remittances smoothly.

Form 15CB - Chartered Accountant Certificate for Foreign Remittance

A practising CA certifies the nature of the payment, applicable rate, and TDS status before larger taxable remittances abroad. This certificate feeds into Form 15CA.
