Does RERA Protect NRIs Buying Property in India?
Short answer: Yes — RERA protections apply the same way to NRI buyers as to resident Indian buyers. You can file a complaint from abroad (most states allow online filing and video-conference hearings), and your refund, interest and compensation rights under s.18 are identical.
What you need to know
- No separate NRI category under RERA — the Act protects any 'allottee', resident or non-resident
- Most state RERA portals accept complaints filed online, and many hearings can be attended by video conference or through an authorised representative/power of attorney
- You can authorise a family member or lawyer in India to represent you at hearings
- Keep all payment records in a form you can access from abroad — bank transfer receipts, the registered Agreement for Sale, and email correspondence with the builder
